Privacy Policy Intro

At The Nityasha Company, we take your privacy seriously. This Privacy Policy explains how we collect, use, store, and share your personal data when you use the Nityasha mobile application (the "App").
By using or accessing Nityasha, you agree to the practices described in this Privacy Policy and allow us to collect, use, and share your information as described herein.
This Privacy Policy is incorporated into and forms part of our Terms of Use. Any capitalised terms not defined here have the meaning given to them in our Terms of Use.
This Policy may be updated from time to time. When we make material changes, we will notify you via the App, by email, or through another reasonable means before the changes take effect. Continued use of the App after a change becomes effective constitutes your acceptance of the revised Policy.
This Privacy Policy is published in compliance with the Digital Personal Data Protection Act, 2023 (DPDPA) and the Information Technology Act, 2000 and rules made thereunder.
What does this Privacy Policy cover?
This Privacy Policy covers how The Nityasha Company handles personal data collected when you use the App. "Personal data" generally means any information that identifies or can reasonably be linked to you as an individual.
This Policy does not cover the data practices of third-party services you may access through the App, or third-party applications linked within the App. We encourage you to review the privacy policies of those services separately.
What is personal data?
Categories of personal data we may collect or process:
Personal data you provide directly includes account/contact data, payment data, content data, and feedback. Personal data collected automatically includes feature usage data and device/network data.
We use your personal data to create and manage your account, process payments, provide and improve the App, send communications, detect fraud, and comply with Indian laws (DPDPA 2023 and IT Act, 2000).
- Account or contact data — such as your name, email address, phone number, and login credentials.
- Payment data — such as your payment method type, last 4 digits of your card, and billing address (processed by Razorpay or Stripe).
- Content data — such as information you enter, upload, or create while using the App.
- Feedback and communications — such as messages, feedback, or survey responses you send us.
- Feature usage data — such as activity logs, features used, and timestamps.
- Device and network data — such as your IP address, device ID, operating system, and app version.
How we may disclose your personal data
We will only share your personal data with the following parties and only for the purposes described in this Policy:
We may create anonymised, de-identified, or aggregated data from your personal data. Such data cannot reasonably identify you and may be used for analytics, research, or business improvement without restriction.
- Service providers (Data Processors) — trusted third parties that assist us in operating the App, including hosting providers, analytics providers, security consultants, support vendors, and payment processors.
- Payment processors — our payment processing partners (e.g., Razorpay, Stripe) collect payment information necessary to process your transactions.
- Third parties you authorise — where you explicitly direct us to share your data with a third party.
- Legal and regulatory authorities — where required by applicable law, court order, or government authority.
- Business transfers — in the event of a merger, acquisition, restructuring, or sale of assets, your personal data may be transferred to the acquiring entity.
We do not sell your personal data to any third party.
Data security
We implement appropriate technical and organisational security measures to protect your personal data against unauthorised access, disclosure, alteration, or destruction. These measures include encryption in transit (TLS), access controls, and regular security reviews.
You are also responsible for maintaining the security of your account. Please use a strong password, do not share your credentials, and log out after each session. Notify us immediately at support@nityasha.com if you suspect any unauthorised access to your account.
While we take reasonable steps to protect your data, no method of transmission over the internet or electronic storage is 100% secure. We cannot guarantee absolute security.
Data retention
We retain your personal data for as long as necessary to provide you with the App, fulfil the purposes described in this Policy, and comply with our legal obligations under applicable Indian law.
Specific retention periods:
When data is no longer needed, we delete or anonymise it securely.
- Account and contact data — retained for as long as your account is active, and for a reasonable period thereafter as required by law.
- Anonymised usage data — deleted from our servers after 30 days.
- Payment data — retained for as long as needed to process transactions and comply with financial reporting obligations.
- Device and network data — retained for as long as needed to ensure the App operates securely and effectively.
Personal data from children
The App is not intended for use by individuals under the age of 18 years. We do not knowingly collect personal data from minors.
If you are under 18, please do not register for or use the App or provide us with any personal data. If a parent or guardian believes that their child has provided us with personal data, please contact us immediately at support@nityasha.com. We will delete such data promptly upon verification.
Your rights under Indian Law (DPDPA 2023)
Under the Digital Personal Data Protection Act, 2023 (DPDPA), you have the following rights as a Data Principal:
We will not discriminate against you for exercising any of your rights under the DPDPA 2023.
- Right to access — you have the right to obtain a summary of personal data we process about you and information about the processing activities carried out.
- Right to correction and erasure — you have the right to correct inaccurate data and to have your personal data erased where it is no longer necessary.
- Right to withdraw consent — where we process your data based on your consent, you may withdraw that consent at any time.
- Right to grievance redressal — you have the right to raise a grievance with our Data Protection Officer and escalate to the Data Protection Board of India.
- Right to nominate — you may nominate another individual to exercise your rights in the event of your death or incapacity.
Exercising your rights
To exercise any of the rights described above, please contact us at privacy@nityasha.com with sufficient information to verify your identity and a clear description of the right you wish to exercise.
We aim to respond to all valid requests within 30 days of receipt. In complex cases, we may extend this by a further 30 days and will notify you accordingly.
You may also delete your account directly from Settings > Account > Delete Account within the App. Upon deletion, your personal data will be handled in accordance with our retention obligations.
If you are not satisfied with our response, you may raise a complaint with the Data Protection Board of India once it is operationally established under the DPDPA 2023.
